If You are hosting Your web site on All in IT's servers, You are responsible for ensuring there is no excessive overloading on All in IT's DNS or servers. You may not use All in IT's servers and Your web site as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, denial of service, or other abusive activities. Server hacking or other perpetration of security breaches is prohibited and All in IT reserves the right to remove sites that contain information about hacking or links to such information. Use of Your web site as an anonymous gateway is prohibited. All in IT prohibits the use of software or scripts run on its servers that cause the server to load beyond a reasonable level, as determined by All in IT. You agree All in IT reserves the right to remove Your web site temporarily or permanently from its hosting servers if All in IT is the recipient of activities that threaten the stability of its network.

Subject to the terms and conditions of this Agreement, All in IT shall attempt to provide the Service for twenty-four (24) hours a day, seven (7) days a week throughout the term of this Agreement. You agree that from time to time, the Service may be inaccessible or inoperable for any reason

If You are using an SSL certificate on a web site hosted by All in IT, All in IT will generate and securely store a corresponding private key. For security reasons, at no time will All in IT release Your private key, even if You request it. If You wish to export Your SSL certificate for use on a non All in IT hosting server, You will need to make a request to All in IT no earlier than thirty (30) days after Your initial SSL subscription began.

By using the Service, You agree You are age 18 or over. The Service is available only to persons who can make legally binding contracts under applicable law.

You agree You have provided accurate, current and complete information in the application process and that You will notify All in IT within five (5) business days when any of the information You provided as part of the application and/or registration process changes. Failure by You, for whatever reason, to respond within five (5) business days to any inquiries made by All in IT to determine the validity of information provided by You, will constitute a material breach of this Agreement. If You provide any information that is inaccurate, not current, false, misleading or incomplete, or if All in IT has reasonable grounds to suspect that Your information is inaccurate, not current, false, misleading or incomplete, All in IT has the absolute right, in its sole discretion, to terminate the Service and close Your account.

DESCRIPTION OF SERVICES

Web Hosting. Web Hosting plans place your site within one or more servers. Resources are shared between many customers on the same servers; however, your site is given a unique address (DNS).

Hosting Backup. Hosting backup and restore services saves all your website files to the cloud once per day. These backup and restore services are available with website hosting plans and may be available for an additional fee with our other hosting service plans.

Migration of Servers. You acknowledge and agree that as a normal course of business, it may be necessary for us to migrate our servers. As a result, even if you have a dedicated IP, you may be assigned a different IP number. We do not warrant that you will be able to consistently maintain your given IP numbers

Website/Server Content.You shall be solely responsible for providing, updating, uploading and maintaining your website or server and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your website or server including, but not limited to, trade or service marks, images, photographs, illustrations, graphics, audio clips, video clips, email or other messages, meta tags, domain names, software and text. You acknowledge and agree that in the course of providing you with technical assistance, it may be necessary for our support staff to modify, alter or remove the content of your hosted product. Your website or server content shall also include any registered domain names provided by you or registered on behalf of you in connection with the Hosting Services.

If access to a third-party hosting website is required in the provision of any Service, you represent and warrant that you are authorized to provide us with access to the third-party hosting account for the purposes of this Service Agreement. You agree that you retain sole contractual and any other legal or fiduciary responsibilities related to your third-party hosting account.

If you request that we install any Third Party Software (defined below) not provided as part of the Hosting Services, you represent and warrant that (1) you have the right to use and install the Third Party Software, (2) you have paid the applicable licensing fees for the Third Party Software, and (3) the Third Party Software does not and shall not infringe on the intellectual property rights of any other person or entity.

PROVISIONS SPECIFIC TO WEB

Storage and Plan Limits.

You acknowledge and agree that inbound UDP is not supported in shared hosting environments.

Website/Server Content. Your website may not include any of the following content: (1) image hosting scripts that allow an anonymous user to upload an image for display on another website (similar to Photobucket or Tinypic); (2) banner ad services for display on other websites or devices (commercial banner ad rotation); (3) file dump/mirror scripts that allow an anonymous user to upload a file for other to download (similar to rapidshare); (4) commercial audio streaming (more than one or two streams); (5) push button mail scripts that allow the user to specify recipient email addresses; (6) anonymous or bulk SMS gateways; (7) backups of content from another computer or website; (8) Bittorrent trackers; or (9) any script that causes a degradation in the performance of our server or network environment.

SERVICE UPTIME GUARANTEE

We offer a Service uptime guarantee of 99.9% (“Service Uptime Guarantee”) of available time per month. If we fail to maintain this Service Uptime Guarantee in a particular month (as solely determined by us), you may contact us and request a credit of 5% of your monthly hosting fee for that month. The credit may be used only for the purchase of further products and services from us, and is exclusive of any applicable taxes. The Service Uptime Guarantee does not apply to service interruptions caused by: (1) periodic scheduled maintenance or repairs we may undertake from time to time; (2) interruptions caused by you from custom scripting, coding or the installation of third-party applications; (3) outages that do not affect the appearance of your website but merely affect access to your website such as FTP and email; (4) causes beyond our control or that are not reasonably foreseeable; and (5) outages related to the reliability of certain programming environments.

DESCRIPTION OF SERVICES

Professional Email. We offer a variety of Services in our Professional Email suite of products, including Email and Online Calendar. All of these Services are available for purchase and some are occasionally included for free with the purchase of other products.

PROVISIONS SPECIFIC TO WORKSPACE AND PROFESSIONAL EMAIL SERVICES

Core Services. Our Email service provides you with the ability to send and receive electronic mail via the Internet using a personal email address linked to your domain name. In order to use our Email service, you must (i) register a domain name, (ii) provide all equipment necessary to establish a connection to the Internet, and (iii) provide your own connection to the Internet.

ANTI-SPAM POLICY

We have a zero-tolerance spam policy. Notwithstanding anything to the contrary in the TERMS AND CONDITIONS / AGREEMENTS, you acknowledge and agree that we may immediately terminate or cancel any account, product, or service, including your use of the Services, that we believe, in our sole and absolute discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email activity. We reserve the right without notice to take all measures of any nature (whether legal, technical or otherwise) to prevent unsolicited bulk email and/or other unauthorized email, messages or campaigns from entering, utilizing or remaining within our network. Accounts, products, or services terminated or cancelled in connection to spam or other unsolicited bulk email activity are ineligible for any refund.

The content you include in any email must be accurate and you may only use the Services to send emails to customers and contacts who have expressly opted in or otherwise given you lawful permission to send emails to them. If you do not have written proof that each recipient on your contact list has expressly opted in or given you permission to send emails to them, they should not be included in any email marketing campaign. You must be able to provide opt-in verification for each contact for each email marketing campaign.

We prohibit the use of third-party, purchased, rented, or harvested mailing lists. You shall not send emails (i) to newsgroups, message boards, distribution lists, or unsolicited email addresses, or (ii) to any recipient who has opted out, unsubscribed, or otherwise objected to receiving such emails from you or another party on whose behalf you may be commissioned. To the extent the Services include features that allow you to request a recipient to confirm that you have the recipient's permission to send messages to such recipient (assuming such use is permitted by laws applicable to you), and such recipient has not responded or does not respond affirmatively to such request for confirmation, you agree that you shall not send messages to that recipient.

You acknowledge and agree that we have the right but not the obligation to copy and/or store your contact lists, customer and contact information, and other information as needed

Spam and Virus Protection. Our Email service includes spam and virus protection. All email sent to and from your email address will automatically be scanned to assist in preventing spam and/or viruses from being transmitted to and from your email program and computer system, and this feature cannot be disabled or configured by you. You acknowledge and agree that our spam and virus protection feature is not guaranteed to be one hundred percent (100%) effective or error-free and may delete email messages and/or attachments that you wish to send or receive, or allow the transmission of spam and/or viruses to and from your email program and computer system. You acknowledge and agree that we shall have no liability to you or any third party with respect to our spam and virus protection feature, your failure to send or receive any email messages and/or attachments as a result thereof, or the transmission of spam and/or viruses to and from your email program and computer system.

PROHIBITED USE

You may not use All in IT LTD to send email campaigns that link to or display pornography, other sexually explicit content, illegal goods or services, pyramid schemes, chain letters, multi-level marketing campaigns, affiliate and network marketing materials, or any other content we deem inappropriate.

You acknowledge and agree that you shall not use the Services to request, collect or send any non-public or personally identifiable information about another user or any other person without their express prior written consent (or the parent’s consent in the case of a minor), illegal information, or any other information you do not have the right to request, collect or distribute.

Unfortunately, some industries yield higher-than-normal abuse rates, which can negatively affect the deliverability for other All in IT LTD users. In order to maintain the highest possible delivery rates for all our users, All in IT LTD is unable to send on behalf of certain industries and senders. This includes, but is not limited to, the following:

  • Pharmaceutical products
  • Work from home, make money on online, and lead generation opportunities
  • Online trading, day trading tips, or stock market-related content
  • Credit repair and get out of debt opportunities
  • Gambling services, products, or tips
  • Multi-level marketing (MLM)
  • List brokers or list rental services
  • Affiliate marketing
  • Mortgage and loan content
  • Nutritional, herbal, and vitamin supplements

It is the responsibility of the sender to ensure that their content falls within these guidelines. We may monitor your account to ensure compliance with these terms and operation within the acceptable standards of the industry and of the email providers you are sending to.

DESCRIPTION OF SERVICES

Cloud services.

PROVISIONS SPECIFIC TO ONLINE STORAGE

Core Services. Online Storage is an online file storage system that allows you to store and share files via the Internet without having to (i) use internal or external hard drives or (ii) email large files. In addition, Online Storage allows you to access your files from any device with Internet access (e.g., work computer, home computer, mobile device, etc.).

Plan Limits. You acknowledge and agree that Online Storage is offered with different plan levels or limits. These plan limits are presented on the Online Storage landing page of this Site and may relate to (i) the amount of storage space purchased, and (ii) the number of files that can be stored and shared. In addition to the limits set forth on the landing page, you are limited to 50,000 folders and you may not store more than 100,000 files within a single directory or folder. In the event you exceed these limits, we may suspend your account until you are in compliance with the limits.

No High-Traffic Website Content. While Online Storage provides you with the ability to share files via public links, it is not designed for the purpose of hosting high-traffic website content. You acknowledge and agree that you will not use Online Storage (i) to host high-traffic website content (as determined by us in our sole and absolute discretion), or (ii) for any other uses in violation of our policies, as may be updated from time to time.

Security. We remind you that password protected files and file folders are only as secure as you keep them. While Online Storage offers the ability to designate files and file folders shared publicly as password protected (i.e., viewable only by those with whom you share a password), it is your responsibility to encrypt or password protect the links to those files and folders. If you fail to do so, it may be possible to access those password protected files and folders through public links. You are solely responsible for the activity that occurs on your account, whether authorized by you or not, and you must keep your account information secure, including without limitation your account passwords. We expressly disclaim any liability or responsibility for any unauthorized use of or access to your account or files or file folders.
